1. About the Platform and these Terms
1.1. Phulkario is an online marketplace that connects independent boutiques and tailoring businesses ("Vendors") with end customers ("Customers", "you"). Vendors list ready-made products, custom-stitching services, and measurement/appointment services; Customers browse, order, and pay through the Platform.
1.2. The Company operates the Platform as an intermediary within the meaning of the Information Technology Act, 2000 and the Consumer Protection (E-Commerce) Rules, 2020. Except where expressly stated, the Company is not the seller or manufacturer of products and does not itself stitch garments or render tailoring services. The contract of sale/service for each order is formed between the Customer and the relevant Vendor.
1.3. These Terms & Conditions ("Terms"), together with our Privacy Policy, Refund, Return & Cancellation Policy and Shipping Policy, govern your access to and use of the Platform. By creating an account, placing an order, or otherwise using the Platform, you agree to be bound by these Terms.
1.4. This document is an electronic record under the Information Technology Act, 2000 and does not require any physical or digital signature.
2. Eligibility
2.1. You must be at least 18 years old and competent to contract under the Indian Contract Act, 1872. By using the Platform you represent that you meet these requirements.
2.2. If you use the Platform on behalf of a business (as a Vendor), you represent that you are authorised to bind that business.
2.3. The Platform is intended for use in India. Prices are in Indian Rupees (₹/INR) and taxes are computed under Indian law.
3. Accounts and Authentication
3.1. Sign-up and login. Customers and Vendors may register and sign in using either (a) a mobile phone number with a one-time password (OTP), or (b) an email address with a password. Some accounts created via OTP may not have a password until one is set.
3.2. Account security. You are responsible for maintaining the confidentiality of your login credentials and OTPs, and for all activity under your account. Notify us immediately at support@phulkario.com of any unauthorised use. Authentication tokens are stored locally in your browser/device (see the Privacy Policy).
3.3. Accuracy. You agree to provide true, current, and complete information and to keep it updated. We may suspend accounts that contain false, misleading, or fraudulent information.
3.4. Account deletion. You may delete your account from the account/profile section. On deletion we deactivate and anonymise your profile (your name is replaced, and email/phone are removed) and delete your cart, wishlist, and saved addresses. Order, payment, and invoice records are retained as required for tax, accounting, and legal compliance and to complete any open transactions. Deletion is processed as described in the Privacy Policy.
4. Vendor Onboarding and Obligations
4.1. Approval. Vendor accounts and boutiques are subject to review and approval by the Company before they may transact. We may approve, reject (with reason), suspend, or remove a Vendor or boutique at our discretion, including for policy breaches.
4.2. KYC. Vendors must provide accurate business and KYC information (which may include GST number, PAN, Aadhaar, bank account / UPI details, and supporting documents) for verification, payouts, and statutory compliance. Bank accounts are validated through our payment partner (including penny-drop verification).
4.3. Vendor responsibilities. Each Vendor is solely responsible for: the accuracy of its listings, pricing, stock, and lead times; the legality, quality, and safety of its products and services; fulfilling orders and honouring promised delivery/production dates; tax compliance on its own supplies; and responding to Customer queries, returns, and disputes in line with Platform policies.
4.4. Commissions and fees. Vendors authorise the Company to deduct platform commission and applicable fees from order proceeds before payout, as set out in the Vendor agreement and dashboards.
5. Listings, Orders, and Custom Stitching
5.1. Listings. Product and service information is provided by Vendors. While we strive for accuracy, the Company does not warrant that listings (descriptions, images, pricing, availability, colours as rendered on your screen) are error-free.
5.2. Order placement. Placing an order is an offer to purchase. The order is confirmed when accepted by the Vendor and/or the Platform. Certain custom orders require explicit Vendor approval before processing.
5.3. Custom-stitched and made-to-measure items. For custom stitching you may submit body measurements, reference/inspiration photos, and special instructions. You are responsible for the accuracy of measurements and instructions you provide. Because these items are made specifically for you:
production begins after order confirmation (and Vendor approval where applicable);
a per-item production lead time applies; and
custom-stitched items are not eligible for return except where the item is defective, damaged in transit, or materially different from what was ordered (see the Refund, Return & Cancellation Policy).
5.4. Measurement & appointment services. Measurement and fitting services may be offered as in-store appointments, at-home (on-site) visits, or online. These may require Vendor acceptance and, where applicable, payment after acceptance.
5.5. Pricing and taxes. Prices are displayed in INR and are inclusive or exclusive of taxes as indicated at checkout. A platform fee and/or delivery charges may be added. GST is applied and invoiced in accordance with the Refund/Return Policy and applicable law; tax invoices/receipts are issued on successful payment.
6. Payments
6.1. Payment processing. Online payments are processed by our third-party payment gateway (Razorpay) and related services. The Company does not collect or store your full card details; card and banking data are handled by the PCI-DSS-compliant gateway.
6.2. Payment methods. Supported methods may include online card/UPI/net-banking via the gateway and, where offered by the Vendor, cash on delivery (COD).
6.3. Failed/duplicate payments. If you are charged but the order is not confirmed, the amount is typically auto-reversed by the gateway. Contact support@phulkario.com for assistance.
6.4. Payouts to Vendors. Vendor proceeds (net of commission, fees, and any adjustments such as return-shipping costs) are paid out through the payment partner per the payout schedule, which may include automatic release a set number of days after delivery.
7. Shipping and Delivery
7.1. Delivery may be fulfilled by the Vendor directly ("boutique-managed") or via an integrated logistics partner (e.g., Shiprocket), or collected in-store, as indicated for each order. Timelines, charges, and tracking are described in the Shipping Policy.
7.2. Estimated delivery and production dates are estimates, not guarantees. Risk and title pass to the Customer on delivery.
8. Returns, Replacements, Cancellations, and Refunds
8.1. Returns, replacements, cancellations, and refunds are governed by the Refund, Return & Cancellation Policy, which forms part of these Terms. Eligibility and time windows depend on the item type, the Vendor's settings, and the reason for return.
9. Reviews, Chat, and User Content
9.1. Customers may post reviews, ratings, images, and communicate with Vendors through the in-app chat and support tickets. You must not post content that is unlawful, defamatory, obscene, infringing, misleading, or that contains another person's private information without consent.
9.2. You grant the Company a non-exclusive, royalty-free, worldwide licence to host, display, and use the content you submit (e.g., reviews and images) for operating and promoting the Platform. You are responsible for the content you submit.
9.3. We may moderate, edit, or remove content and may withhold or remove reviews that violate these Terms.
10. Acceptable Use
10.1. You agree not to: (a) use the Platform for any unlawful purpose; (b) infringe intellectual property or other rights; (c) upload malware or attempt to gain unauthorised access; (d) scrape, harvest, or misuse data; (e) interfere with the Platform's operation; (f) impersonate others; or (g) circumvent fees by transacting off-Platform after being introduced through it.
11. Intellectual Property
11.1. The Platform, including its software, design, logos, and content (excluding Vendor and user content), is owned by or licensed to the Company and protected by applicable laws. No rights are granted except as expressly stated. "Phulkario" and associated marks may not be used without prior written permission.
12. Third-Party Services
12.1. The Platform integrates third-party services including payment (Razorpay/RazorpayX), logistics (Shiprocket), push notifications (Firebase Cloud Messaging), image hosting (Cloudinary), and mapping/geocoding. Your use of those features may be subject to the third party's own terms and privacy practices.
13. Disclaimers and Limitation of Liability
13.1. The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, the Company disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
13.2. As an intermediary, the Company is not responsible for the quality, workmanship, fit, safety, or legality of Vendor products or services, or for acts or omissions of Vendors or logistics/payment partners. Disputes regarding an order are primarily between the Customer and the Vendor; we may assist in resolution.
13.3. To the maximum extent permitted by law, the Company's aggregate liability arising out of or relating to the Platform or any order shall not exceed the amount paid by you for the specific order giving rise to the claim. The Company shall not be liable for indirect, incidental, special, or consequential damages.
13.4. Nothing in these Terms limits liability that cannot be excluded under applicable law, including the Consumer Protection Act, 2019.
14. Indemnity
14.1. You agree to indemnify and hold harmless the Company, its officers, employees, and partners from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your content, or your violation of any law or third-party right.
15. Suspension and Termination
15.1. We may suspend or terminate your access, with or without notice, for breach of these Terms, suspected fraud, legal requirement, or risk to the Platform or other users. Provisions that by their nature should survive termination (e.g., payments owed, IP, disclaimers, limitation of liability, governing law) will survive.
16. Changes to these Terms
16.1. We may update these Terms from time to time. The "Last updated" date reflects the latest version. Material changes will be notified through the Platform or by other reasonable means. Continued use after changes constitutes acceptance.
17. Governing Law and Dispute Resolution
17.1. These Terms are governed by the laws of India. Subject to applicable consumer-protection law, the courts at Mohali, Punjab shall have exclusive jurisdiction.
17.2. Before initiating formal proceedings, you agree to first contact our Support to attempt good-faith resolution.

These Terms of Use and Vendor Terms and Conditions (“Terms”) govern your access to and use of the Phulkario Vendor App (“App”, “Platform”, or “Phulkario”) operated by MK Apps PVT LTD (“Company”, “we”, “us”, or “our”).
By registering as a Vendor, accessing the Vendor App, listing products, accepting orders, communicating with Customers, or otherwise using the Platform, you agree to be bound by these Terms.
If you do not agree with these Terms, you should not register as a Vendor or use the Platform.

Phulkario operates as an online marketplace that connects Customers with boutiques, tailors, designers, fashion businesses, and other Vendors.
Phulkario provides the technology and marketplace platform through which Vendors can display products, receive orders, communicate with Customers, and manage their business activities.
Unless expressly stated otherwise, Vendors are independent businesses and are responsible for the products and services they provide to Customers.
2. Acceptance of Terms
By creating a Vendor account or using the Platform, you confirm that:
You have read and understood these Terms.
You agree to comply with these Terms.
You are legally capable of entering into an agreement.
You are at least 18 years old.
The information you provide is accurate and complete.
You have the authority to operate the business represented through your Vendor account.
You will comply with all applicable laws and regulations.
You will provide Customers with products and services as described in your listings.
These Terms apply together with our Privacy Policy and other policies published on the Platform.

4. Vendor Account Registration
To become a Vendor, you may be required to provide certain information, including:
Vendor/owner name
Business or boutique name
Email address
Phone number
Business address
GST information
PAN information
Aadhaar/KYC information where applicable
Bank account details
UPI information
Business documents
Product and business information
You are responsible for ensuring that all information provided to Phulkario is accurate, current, and complete.
You must notify Phulkario if any important Vendor information changes.
5. Vendor Verification and KYC
Phulkario may require Vendors to complete identity, business, tax, KYC, or payment verification before allowing certain Platform features.
We may request documents such as:
GST certificate
PAN card
Aadhaar documentation
Business registration documents
Bank verification documents
Other documents reasonably required for verification
Providing false, misleading, forged, altered, or fraudulent documents may result in immediate suspension or termination of the Vendor account.
Phulkario may also refuse or delay Vendor approval where verification requirements are not satisfactorily completed.
6. Vendor Responsibilities
Vendors are responsible for operating their business professionally and lawfully.
The Vendor must:
Provide accurate product information.
Upload genuine product photographs.
Clearly describe products and services.
Provide accurate pricing.
Provide accurate size and measurement information.
Clearly disclose material, fabric, colour, and other important product information.
Fulfil accepted orders.
Maintain appropriate product quality.
Package products appropriately.
Communicate professionally with Customers.
Respond to legitimate Customer queries.
Handle delivery responsibilities where shipping is handled by the Vendor.
Provide appropriate remedies for genuine product-related complaints.
Comply with applicable consumer, tax, business, and other laws.
Protect Customer information received through Phulkario.
Avoid fraudulent or misleading activities.
7. Product Quality
Product quality is primarily the responsibility of the Vendor.
Vendors are expected to provide products that reasonably match the description, photographs, specifications, measurements, fabric/material information, and customisation requirements presented to Customers.
The Vendor is responsible for:
Cloth/fabric quality
Material quality
Stitching quality
Workmanship
Product finishing
Size accuracy
Measurement accuracy
Customisation accuracy
Colour and product representation
Packaging
Product condition before dispatch
Phulkario expects Vendors to maintain a high standard of quality because Customer trust and marketplace reputation are important to the Platform.
8. Customer Complaints Regarding Quality
If a Customer reports that a product is of poor quality, materially different from the listing, defective, incorrectly stitched, incorrectly customised, damaged, or otherwise not as represented, the Customer may contact Phulkario Support.
Our support team may investigate the complaint.
We may request:
Order details
Product photographs
Videos
Customer explanations
Vendor explanations
Product listing information
Chat history
Shipping information
Other relevant evidence
The support team will review the available information and determine an appropriate resolution based on the circumstances and applicable policies.
9. Genuine Quality Complaints and Refunds
Where a genuine product-quality issue is established, the Vendor may be required to provide an appropriate remedy.
Depending on the circumstances, the remedy may include:

Repair
Correction
Re-stitching
Partial refund
Full refund
Another reasonable resolution
The final resolution may depend on the nature and seriousness of the issue.
Vendors agree to cooperate with Phulkario during complaint and refund investigations.
Repeated failure to resolve genuine Customer complaints may result in additional action against the Vendor.
10. Vendor Quality and Ratings
Customer ratings and reviews are an important part of the Phulkario marketplace.
Vendors may be ranked based on factors such as:
Customer ratings
Customer reviews
Product quality
Order fulfilment
Complaint history
Cancellation history
Delivery performance
Customer satisfaction
Marketplace activity
Other legitimate Platform signals
Vendors consistently receiving good reviews and providing good products and service may receive greater visibility or ranking within the Platform.
Phulkario may modify ranking mechanisms from time to time.
No Vendor is guaranteed a particular ranking or level of visibility.
11. Fake Reviews and Rating Manipulation
Vendors must not attempt to manipulate ratings or reviews.
Prohibited activities include:
Creating fake Customer accounts
Creating fake reviews
Paying or incentivising people to create misleading reviews
Asking Customers to provide dishonest ratings
Manipulating review systems
Threatening Customers regarding reviews
Removing or hiding relevant information from Customers
Using third parties to artificially increase ratings
Phulkario may investigate suspected manipulation and take appropriate action.
12. Product Listings
All Vendor listings must be accurate and truthful.
A Vendor must not list products that:
The Vendor does not have the ability to supply
Are materially different from the description
Use misleading photographs
Contain false information
Violate applicable laws
Infringe intellectual property rights
Are prohibited by Phulkario
Are counterfeit or unlawfully reproduced
Phulkario may remove listings that violate these Terms.
13. Product Photographs and Content
Vendors are responsible for the photographs, videos, descriptions, logos, designs, and other content uploaded to the Platform.
You confirm that you have the necessary rights or permissions to use the content you upload.
You must not upload content that:
Infringes copyright
Infringes trademarks
Violates another person's privacy
Is fraudulent or misleading
Contains unlawful material
Violates Platform rules
Phulkario may remove content that violates these Terms or applicable law.
14. Pricing
Vendors are responsible for setting accurate product prices.
Vendors must ensure that:
Listed prices are accurate.
Applicable taxes are correctly represented.
Any additional charges are clearly disclosed.
Customers are not charged amounts that were not appropriately disclosed.
Phulkario may provide tools for managing product prices, discounts, offers, or promotions.
15. Orders
When a Customer places an order, the Vendor is responsible for reviewing and fulfilling the order according to the applicable Platform requirements.
The Vendor should:
Confirm the order where required.
Prepare the correct product.
Follow Customer customisation instructions.
Use the correct measurements where applicable.
Package the product safely.
Dispatch the product within the applicable timeframe.
Update order status accurately.
Cooperate with Customer support if an issue occurs.
Accepting an order generally creates an obligation for the Vendor to fulfil that order unless cancellation is permitted under the applicable policy.
16. Custom-Stitched and Made-to-Order Products
For custom products, Vendors are responsible for carefully reviewing:
Measurements
Customer instructions
Size requirements
Customisation requests
Fabric/material selections
Design specifications
Vendors should contact the Customer or Phulkario Support if important information required to fulfil an order is missing or unclear.
Where a Vendor incorrectly produces a custom item due to Vendor error, the Vendor may be responsible for correction, replacement, refund, or another appropriate remedy.
17. Customer Measurements and Custom Information
Some Phulkario products may require Customer measurements.
Vendors must use Customer measurements only for legitimate purposes connected with fulfilling the relevant order.
Vendors must not:
Sell measurements
Share measurements with unauthorised persons
Use measurements for unrelated purposes
Publish Customer measurements
Use Customer photographs for unrelated purposes without appropriate permission
Vendors must take reasonable steps to protect Customer information.
18. Shipping and Delivery
At the current stage of Phulkario, shipping may be handled directly by the Vendor.
The Vendor may therefore be responsible for:
Packaging
Courier selection
Shipment booking
Dispatch
Tracking
Delivery coordination
Delivery-related communication
Handling delivery delays where applicable
Vendors must provide accurate shipping information.
Phulkario may introduce integrated shipping and logistics services in the future.
If integrated shipping is introduced, Vendors may be required to use the designated logistics service or shipping system according to the applicable Shipping Policy.
19. Shipping Policy
The Phulkario Shipping Policy forms part of these Terms.
Shipping timeframes, dispatch requirements, tracking requirements, delivery responsibilities, failed deliveries, damaged shipments, and other shipping-related matters may be governed by the Shipping Policy.
Vendors are responsible for reviewing the current Shipping Policy and complying with its requirements.
20. Cancellation Policy
Orders may be cancelled according to the Phulkario Cancellation Policy.
A Vendor must not cancel orders unnecessarily or repeatedly.
Repeated cancellations may negatively affect:
Vendor ranking
Customer trust
Account standing
Marketplace visibility
Phulkario may restrict or suspend Vendors with excessive or unjustified cancellations.
21. Refund & Return Policy
Returns and refunds are governed by the Phulkario Refund & Return Policy.
Vendors agree to cooperate with legitimate refund and return investigations.
Where the Vendor is responsible for a product issue, the Vendor may be required to bear the applicable cost of the refund, replacement, correction, return, or other remedy, subject to the applicable policy and law.
22. Vendor Payments and Payouts
Vendor payments may be processed through authorised payment partners.
Phulkario may deduct or adjust applicable:
Platform fees
Payment processing charges
Refund amounts
Chargebacks
Taxes
Adjustments
Other agreed charges
Vendor payouts may be subject to verification, settlement periods, dispute periods, payment-provider requirements, and applicable law.
Phulkario may temporarily hold or delay payouts where reasonably necessary to investigate suspected fraud, disputes, chargebacks, or other legitimate concerns.
23. Taxes
Vendors are responsible for complying with applicable tax laws.
This may include:

Income tax
Applicable invoices
Tax records
Business registration requirements
Other applicable governmental requirements
Vendors are responsible for obtaining appropriate professional tax advice where required.
24. Customer Communication
Vendors may communicate with Customers through Platform-supported communication features for legitimate order-related purposes.
Communication must remain professional.
Vendors must not use the Platform to:
Harass Customers
Threaten Customers
Send abusive messages
Request inappropriate information
Conduct fraudulent transactions
Mislead Customers
Attempt to move transactions outside Phulkario for the purpose of avoiding applicable Platform requirements or fees
25. Off-Platform Transactions
Vendors must not intentionally use Phulkario customer information to bypass the Platform.
For example, a Vendor must not obtain a Customer through Phulkario and then pressure or encourage the Customer to complete the same transaction outside Phulkario solely to avoid Platform charges, policies, protections, or payment procedures.
Phulkario may take action where such activity is detected.
26. Prohibited Products and Activities
Vendors must not use Phulkario to sell or promote products or services that are illegal, fraudulent, counterfeit, stolen, unsafe, or otherwise prohibited by applicable law or Platform rules.
Phulkario may restrict categories of products or services at its discretion.
We may remove prohibited listings without prior notice where reasonably necessary.
27. Intellectual Property
Phulkario and its software, branding, design, logos, features, interfaces, and technology are owned by or licensed to MK Apps PVT LTD and are protected by applicable intellectual property laws.
Vendors receive a limited, non-exclusive, non-transferable right to use the Platform for legitimate business purposes while their account remains active.
Vendors must not:
Copy the Platform
Reverse engineer the Platform
Reproduce Platform designs without permission
Use Phulkario branding without permission
Attempt to access source code
Interfere with Platform security
Use automated systems to abuse Platform functionality
28. Vendor Content Licence
By uploading product photographs, descriptions, logos, videos, or other content to Phulkario, you grant Phulkario a limited licence to host, reproduce, display, format, and distribute that content as reasonably necessary to operate and promote the marketplace.
This licence does not transfer ownership of your underlying content to Phulkario.
You remain responsible for ensuring that you have the rights necessary to provide the content.
29. Privacy and Customer Data
Vendor use of Customer information is also governed by the Phulkario Privacy Policy and applicable privacy laws.
Vendors must protect Customer information received through the Platform.
Any misuse, unauthorised disclosure, sale, or inappropriate use of Customer data may result in suspension or termination of the Vendor account and may also result in legal consequences where applicable.
30. Account Security
Vendors are responsible for maintaining the security of their accounts.
You must:
Keep your password confidential.
Keep OTPs confidential.
Not share login credentials unnecessarily.
Immediately report suspected unauthorised access.
Ensure authorised employees or representatives use the account responsibly.
You may be responsible for activity performed through your account where the activity results from your failure to protect your credentials.
31. Fraud and Misuse
Phulkario has zero tolerance for fraudulent activity.
Examples include:
Fake orders
Fake reviews
Fake accounts
Payment fraud
False KYC documents
Misleading product listings
Manipulated ratings
Customer scams
Abuse of refunds
Chargeback manipulation
Identity fraud
Unauthorised access
Misuse of Customer data
Phulkario may suspend accounts, hold relevant payouts, remove listings, investigate transactions, and cooperate with lawful authorities where appropriate.
32. Account Suspension or Termination
Phulkario may suspend, restrict, or terminate a Vendor account where we reasonably believe that:
These Terms have been violated.
The Vendor has provided false information.
KYC verification has failed.
Fraudulent activity is suspected.
Customers are repeatedly receiving poor-quality products.
The Vendor repeatedly fails to fulfil orders.
There are excessive cancellations.
Customer information has been misused.
The Vendor has engaged in unlawful activity.
The Vendor has harmed marketplace integrity.
The Vendor has violated applicable law.
The Vendor's activity creates a security or reputational risk.
Where appropriate, Phulkario may provide the Vendor with an opportunity to respond or resolve the issue.
However, immediate suspension may occur where necessary to protect Customers, Vendors, the Platform, or legal rights.
33. Vendor Legal Responsibility
Vendors operate their own businesses independently.
The Vendor is responsible for its products, services, employees, representatives, taxes, business licences, legal compliance, and customer obligations.
If a Vendor causes harm to a Customer because of defective products, poor workmanship, misleading information, unlawful conduct, negligence, fraud, or other Vendor-controlled activity, the Vendor may be responsible for the resulting consequences to the extent permitted by applicable law.
Phulkario may cooperate with Customers, authorities, payment providers, or other relevant parties when required by law or reasonably necessary to investigate serious complaints.
34. Quality Expectations
Phulkario aims to provide Customers with access to reliable Vendors and quality products.
By joining the Platform, Vendors acknowledge that maintaining quality is essential to marketplace success.
Vendors are expected to:
Provide high-quality products.
Match products with their descriptions.
Use appropriate materials.
Follow Customer customisation instructions.
Maintain professional workmanship.
Package products appropriately.
Communicate honestly with Customers.
Resolve genuine problems responsibly.
Consistently good performance may result in better marketplace visibility.
35. Marketplace Ranking
Phulkario may use automated and manual mechanisms to determine Vendor visibility.
Ranking may consider legitimate signals including:
Reviews
Ratings
Customer satisfaction
Product quality
Order completion
Cancellation rate
Complaint rate
Delivery performance
Vendor activity
Other marketplace signals
Ranking is not guaranteed and may change based on Platform activity.
Phulkario may modify ranking systems to improve Customer experience and marketplace quality.
36. Disclaimer Regarding Independent Vendors
Phulkario is a marketplace platform.
Unless explicitly stated otherwise, products are supplied by independent Vendors.
Phulkario does not manufacture, stitch, inspect, package, or directly control every product listed by Vendors.
We may take reasonable steps to investigate complaints and maintain marketplace quality, but Vendors remain primarily responsible for their products and services.
37. Platform Availability
We aim to keep the Platform available and operational, but we do not guarantee uninterrupted access.
The Platform may occasionally be unavailable due to:
Maintenance
Updates
Technical issues
Network problems
Security incidents
Third-party service interruptions
Force majeure events
Other circumstances beyond our reasonable control
We may modify, suspend, or discontinue Platform features where reasonably necessary.
38. Third-Party Services
Phulkario may integrate third-party services including payment providers, logistics providers, cloud providers, notification services, analytics services, maps, and other technology providers.
Third-party services may be governed by their own terms and policies.
Phulkario is not responsible for independent failures or policies of third-party providers except to the extent required by applicable law.
39. Limitation of Liability
To the maximum extent permitted by applicable law, Phulkario and MK Apps PVT LTD will not be responsible for losses arising from matters outside our reasonable control, including:
Vendor misconduct
Customer misconduct
Product defects caused by Vendors
Vendor shipping failures
Customer-provided incorrect information
Third-party payment failures
Courier delays
Internet/network failures
Unauthorised access resulting from Vendor credential sharing
Events beyond our reasonable control
Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.
40. Indemnification
To the extent permitted by applicable law, Vendors agree to indemnify and hold harmless MK Apps PVT LTD, Phulkario, and their authorised personnel from claims, losses, damages, liabilities, or expenses arising from:
Vendor products
Vendor services
Vendor negligence
Vendor fraud
Vendor violation of these Terms
Vendor violation of applicable law
Vendor infringement of third-party rights
Vendor misuse of Customer information
Vendor disputes with Customers
This provision does not limit any rights available under applicable law.
41. Changes to These Terms
We may update these Terms from time to time.
Changes may be made because of:
New Platform features
Business changes
New policies
Legal requirements
Security requirements
Changes to marketplace operations
The updated version will be made available through the Platform.
Your continued use of Phulkario after an update may constitute acceptance of the revised Terms where permitted by applicable law.
42. Governing Law
These Terms shall be interpreted in accordance with the applicable laws of India.
Any dispute shall be subject to the jurisdiction of the courts having appropriate jurisdiction, subject to applicable law.
43. Content & Conduct
Phulkario has zero tolerance for objectionable, abusive, fraudulent, illegal, misleading, or inappropriate content or behavior.
Vendors are responsible for the products, images, descriptions, and other content they submit to Phulkario.
Content that violates our Terms may be removed immediately, and the Vendor account may be suspended or terminated

45. Important Vendor Acknowledgement
By registering and using the Phulkario Vendor App, you acknowledge that:
You are responsible for the quality of your products.
You are responsible for accurately describing your products.
You are responsible for fulfilling accepted orders.
You are responsible for shipping where shipping is handled by you.
You must cooperate with genuine Customer complaints.
You may be required to provide refunds or other remedies for genuine Vendor-related issues.
Customer ratings and reviews may affect your marketplace ranking.
Repeated poor-quality complaints may affect your account and visibility.
Misuse of Customer information is prohibited.
Fraudulent activity may result in suspension, termination, and potentially legal action.
You must comply with applicable laws.
Phulkario may investigate complaints and take appropriate action to protect Customers and the marketplace.
By continuing to use the Platform, you agree to these Terms and all applicable Phulkario policies.
